Just 'Cause We Want To?

There are very few labor contracts that don't place some limits on the Employer's right to discipline and discharge employees - whether those limits are stated as "just cause," "reasonable cause," "sufficient cause" or sometimes simply as "cause," they constrain the Employer from firing people "just 'cause we want to." The problem for labor relations professionals, and by that term I mean both Employer and Union representatives, is that the labor contract seldom defines what the parties meant by "just cause." But fear not! The fact that the parties haven't defined it, doesn't mean that there's not a definition - or more accurately, a set of questions, or tests that can be used by either party to determine whether there is just cause for discipline in any particular case.

The "seven tests of just cause," were originally formulated by Arbitrator Carroll Daugherty in 1966. Every labor relations professional learns them in infancy:

1) NOTICE: Did the Employer give to the employee forewarning or foreknowledge of the possible or probable consequences of the employee's disciplinary conduct?

2) REASONABLE RULE OR ORDER: Was the Employer's rule or managerial order reasonably related to a) the orderly, efficient and safe operation of the Employer's business, and b) the performance that the Employer might properly expect of the employee?

3) INVESTIGATION: Did the Employer, before administering the discipline to an employee, make an effort to to discover whether the employee did in fact violate or disobey a rule or order of management?

4) FAIR INVESTIGATION: Was the Employer's investigation conducted fairly and objectively?

5) PROOF: At the investigation did the "judge" obtain substantial evidence or proof that the employee was guilty as charged?

6) EQUAL TREATMENT: Has the Employer applied its rules even-handedly and without discrimination to all employees?

7) PENALTY: Was the degree of discipline administered by the Employer in a particular case related to a) the seriousness of the employee's proven offense, and b) the record of the employee in his/her service with the Employer?

There they are. Seven little tests. Pretty simple, right? Well, not necessarily - as Adolph Koven's almost 500 pages of discussion, examination and analysis amply demonstrate.

Mr Koven was an arbitrator, mediator and fact-finder for more than 40 years. "Just Cause: The Seven Tests" is the BEST, and certainly the most detailed, book on the subject available today. No labor relations professional should handle disciplinary grievances and certainly should not advocate disciplinary arbitration cases, without a solid understanding of just cause, and Mr Koven is the best teacher there is.

"Just Cause: The Seven Tests" uses each test as a primary topic heading. Mr Koven's exposition is both detailed and straight forward - he's writing for practicioners, not lawyers - and by the time he's done, there's very little chance that you'll have any unanswered questions, (notice I say "very little chance" - I've been doin' this work for 43 years - if there's one thing I've learned, it's that there's always something new...).

Bottom line: No matter which side of the table you happen to be on, if your labor contract sets a just cause standard for discipline, Adolph Koven's "Just Cause: The Seven Tests" should be in your library.

The author of The Golden Lotus is Lanling Xiaoxiaosheng, whose name, a pseudonym, means "Scoffing Scholar of Lanling." His great work, written in the late Ming but set in the Song Dynasty, is a virtuoso collection of voices and vices, mixing in poetry and song and sampling different social registers, from popular ballads to the language of bureaucrats, in order to recreate and comment mordantly on the society of the time.
This edition features a new introduction by Robert Hegel of Washington University, who situates the novel for contemporary readers and explains its greatness as the first single-authored novel in the Chinese tradition. This translation contains the complete, unexpurgated text as translated by Clement Egerton with the assistance of Shu Qingchun, later known as Lao She, one of the most prominent Chinese writers of the twentieth century. The translation has been pinyinized and corrected.

A lingering Chinese erotic life

Golden Lotus is a wonderful story if you want to discover the forbidden topic of ancient Chinese erotic life style. It is the only Chinese book I have read so far that describes the love making scenes in detail. It is about the traditional Chinese customs and how to make friends and deal with your enemies. And also, if you love Chinese food, the story makes your mouth water as well as it is filled with banquets and tea sessions. The story is slow and filled with wonderful human emotions. If you want to know more about the traditional Chinese life style, literature, customs and culture, this is the book for you, go and get it and you will have so much fun!

The latin parts have been translated!!!!!

When I first read this book, the racy parts were all written in latin. The characters would meet alone somewhere and then the text would suddenly drift of into the vulgate.... It was fun to imagine what they were doing, and your imagination could run wild. Now you can read what really went on when the book got too sexy for the Victorians. A lot of fun to read.

Heavy going, but great if you have perseverance

This is a classic novel of Ming dynasty China. It paints an amazing picture of everyday life - the domestic strife, the courtiers and sycophants, the corruption, the use of pressure (subtle or otherwise), all within a Confucian framework. While both the heroine and hero ultimately die tragically, the novel offers hope for the future.
And yes, there is a fair amount of graphically-described sex, so if you are not happy with this, don't buy the book. But it is not pornography. It is a realistic picture of what life was like in those days, and a varied sex life was deemed normal and healthy, and not something to be worried about. The book does make the point that excess in sex as in anything else is ultimately destructive, and invites the reader to learn the moral lesson.
The non-Pinyin proper names will confuse some readers, and there are few notes for clarity. Also the habit of giving numbers to frequently-ised names is unfriendly to the modern reader, though it may help to distinguish between characters. Put if you can cope with this, and are prepared to put up with the leisurely pace of the Chinese gentleman, this is a fine book.

Contributions will be based on analysis of the same 400,000 word corpus from online Q+A forums, and contributors employ methodologies including corpus-based discourse analysis, audience perceptions, Multi-Dimensional analysis, pragmatic analysis, and keyword analysis.

In their introductory and concluding chapters, the volume editors compare and contrast the findings from each method and assess the degree to which ‘triangulating’ multiple approaches may provide a more nuanced understanding of a research question, with the aim of identifying a set of complementary approaches which could arguably take into account analytical blind spots. Baker and Egbert also consider the importance of issues such as researcher subjectivity, type of annotation, the limitations and affordances of different corpus tools, the relative strengths of qualitative and quantitative approaches, and the value of considering data or information beyond the corpus. Rather than attempting to find the ‘best’ approach, the focus of the volume is on how different corpus linguistic methodologies may complement one another, and raises suggestions for further methodological studies which use triangulation to enrich corpus-related research.

Paul Baker is Professor of English Language at Lancaster University. His research involves applications of corpus linguistics and his recent books include Using Corpora to Analyze Gender (2014), Discourse Analysis and Media Attitudes (2013) and Sociolinguistics and Corpus Linguistics (2010). He is the commissioning editor of the journal Corpora.

Jesse Egbert is Assistant Professor of Linguistics and English Language at Brigham Young University. His research focuses on register variation and methodological issues in corpus linguistics. His research has been published in journals such as Corpora, International Journal of Corpus Linguistics, Applied Linguistics, and Journal of English Linguistics.

Inspiring collection of personal triumphs

I love stories of people who've gone from nothing to something and this collection puts a smile on my face every time I read one. The stories really motivate you to stay positive and work hard to get what you want out of life. The names are familiar, but their stories weren't, at least not to me. I knew about Arnold Schwarzenegger's background, but the stories about others, like Jerry Seinfield and Ellen DeGeneres, were new to me. Seeing Seinfield now, I just can't imagine him choking on stage like he did with his first stand up attempt. I would have probably quit but he never gave up. That's the theme of all the stories really. Never give up.

It's so easy to see people on TV or in movies and think oh well they've got it easy, they're rich and successful. But when I read their stories I realize they started out the same as I did, sometimes a lot worse off even. It's such an inspiring collection of personal triumphs, really enjoyed reading it!

This book is full of inspiration gems!

Knowing the stories of great people from all walks of life is an effective way for one to learn different lessons in life. This is my main conclusion after reading this book. I cannot pinpoint what are the most important lessons I learned since it seemed that each story is unique from each other.

This book, as the subtitle states, is a collection of stories of different people. When this was offered to me by Jason, the author, I asked myself what are the possible lessons I can get from the people featured here. I had a bias towards famous business persons, statesmen; those people who are usually featured in biography books or who have their memoir. So when I read that there are people from entertainment industry, I was intrigued. I asked what could I get from them aside from seeing them show their skills in movies.

Seth's charm and magic makes Broadway that closer to home wherever you are through his writing. I started listening to him on Sirius XM and then started watching his masterclasses and deconstructions. This book is a must-have for anyone who keeps up with the broadway buzz and you learn things about your favorite stars that you would've never known before.
